New Mexico Gambling Laws & Regulation

Tribal casinos operate under the Indian Gaming Regulatory Act, commonly known as IGRA, along with tribal-state gaming compacts negotiated between the State of New Mexico and federally recognized tribes. These agreements help define permitted games, regulatory responsibilities, revenue-sharing terms, licensing standards, and jurisdictional issues.

Tribal casinos in New Mexico typically offer:

• Sports betting at select properties
• Hotel, dining, and entertainment amenities

Because tribes are sovereign governments, tribal gaming is regulated through a combination of tribal gaming commissions, federal oversight, and compact-based state responsibilities.

Tribal gaming operators in New Mexico include several pueblos, nations, and tribes, such as:

• Pueblo of Santa Ana
• Pueblo of Sandia
• Pueblo of Isleta
• Pueblo of Pojoaque
• Mescalero Apache Tribe
• Pueblo of Acoma
• Pueblo of Laguna

New Mexico gambling laws also authorize gaming at licensed racetracks, commonly referred to as racinos. These local NM casinos operate under a separate legal framework from tribal casinos and may offer electronic gaming machines in addition to pari-mutuel horse racing. Unlike tribal casinos, racinos are subject to direct state regulation and must comply with licensing, operational, and oversight requirements established in New Mexico law.

Under New Mexico gambling laws, racetrack casinos may legally offer:

• Live horse racing
• Simulcast horse race wagering
• Pari-mutuel betting
• Slot machines
• Approved electronic table games

Racetrack gaming is overseen by the New Mexico Gaming Control Board, while horse racing and pari-mutuel wagering are regulated by the New Mexico Racing Commission, with each agency responsible for enforcing the state's applicable gaming laws and regulations.

New Mexico did not pass a traditional statewide sports betting law after the U.S. Supreme Court overturned PASPA in 2018. Instead, several tribal casinos began offering in-person sports betting under their existing Class III gaming compacts.

As a result, New Mexico’s sports betting market is unusual. Legal sportsbooks operate at select tribal casinos, but there is no statewide mobile sports betting market and no commercial sportsbook licensing structure.

Legal sports betting in New Mexico is currently limited to:

• In-person wagering at participating tribal casinos
• Players aged 21 or older

Statewide mobile sports betting remains unavailable. In 2026, renewed discussion emerged around reopening compact talks to allow online sports betting, but no full statewide system has been enacted.

New Mexico has not legalized state-regulated online casino gambling. That means there are currently no New Mexico-licensed online casinos offering real-money online slots, blackjack, roulette, baccarat, video poker, or live dealer games. The state also has not legalized online poker or statewide mobile sports betting.

Because lawful in-state iGaming is unavailable, some New Mexico residents look to offshore gambling sites that accept U.S. players. These sites are licensed by trusted gaming commissions and legally accept NM players aged 18 or older.
